Certified copy of Marriage Certificate
Effective January 1, 2010, California State Law, Health and Safety Code Section 103526, permits only authorized persons as defined in the application to receive certified copies of marriage records.
Certified copies of public marriage records are only available from the County Clerk’s Office in the county where the public marriage license was issued. Only the two individuals named on the marriage certificate, family members, and certain law enforcement agencies can obtain copies of public marriage records.
Certified copies of confidential marriage records are only available from the County Clerk’s Office in the county where the confidential marriage license was issued. Only the two individuals named on the confidential marriage certificate can obtain copies of confidential marriage records.
The cost of a copy is located on our Fee Schedule payable to the San Benito County Clerk. If no record of the marriage is found, the fee will be retained for searching the record (Health & Safety Code Section 103650) and a Certificate of No Record will be issued to the applicant.
